Terms and Conditions

Introduction 
A driving instructor who gives lessons in a motor car in return for payment must be on the “Register of Approved Driving Instructors” (ADIs). To gain entry to the register instructors need to pass a series of examinations administered by the Driving Standards Agency (DSA). ADIs are regularly tested by DSA to check their continued ability to give instruction to an acceptable standard. 
The instructor should at all times, to the best of his or her ability, endeavour to teach the client correct driving skills according to DSA’s recommended syllabus. 
Instructors will advise pupils when to apply for their theory and practical driving tests, taking into consideration waiting times at the local test centre and the potential for achieving the driving test pass standard. 
Students must hold a valid current driving licence for the category of driving lessons required and produce the relevant documents at the first lesson. They must also inform their Instructor of any changes to their licence. 
They must be able to read a number plate at the required distance. 
If any Student wishes to cancel a lesson then 24 hours notice must be given, 48 hours for lessons of 2 hours or more and 7 days for Intensive Courses, Otherwise a full charge will be made. We would also expect Students to be punctual, as instructors will only wait for 10 minutes before that lesson is cancelled.

Instructors 
All Mitchells School of Motoring Instructors will give a full one hour’s lesson. If an instructor is late by more than 10 minutes then a lesson can be rescheduled, the time added on at the end or carried over to the following lesson at no charge to the Student. 
Mitchells School of Motoring Instructors work on a franchise basis, being self-employed with their own car, equipment, and insurance. Mitchells School of Motoring is simply an administrative agent. All contracts are between you the Student and the Instructor. 
Mitchells School of Motoring is not responsible for monies paid booking times agreed and have no liability for any loss or damage to property belonging to, or in the possession of the student during the lesson. Claims or complaints of any kind, including those for re-imbursement of unused lesson costs, should be made directly to the Instructor. If any issue cannot be resolved then in writing to Mitchells School of Motoring.

Payments 
All payments must be made to the instructor before the start of the lesson and tuition fees agreed by both parties beforehand. Cheques are to be paid 7 days in advance and debit card payments 4 days. Credit cards are also accepted incurring a 3% charge. 
Special Offers are as stated and cannot be swapped or exchanged. 
Gift vouchers are to the value of their intent and not redeemable for cash, if there is a price increase before the voucher is exchanged then the remainder is to be paid or a reduction of lessons may occur. If a voucher is intended for a new driver and the Student has already driven the same rule applies. 
Any refund due for cancelation of lessons will incur a charge of 10% or £10.00 (whichever is the greater) for admin purposes (except where the Distance Selling Regulations apply). If reimbursements are not claimed within 28 days they will be forfeited. 
Block payments for Lessons not taken within 6 Months of payment will be forfeited. 
Mitchells School of Motoring reserves the right to increase the prices of any lessons or courses without notice. 
Block payments that have been made whilst having lessons will not incur the increase. 
Block payments where lessons have not started will incur the increase. 
Where a student is already undertaking lessons then 2 weeks notice of any price increase will be given. 
If an offer is taken where the lesson prices are discounted and then a refund is requested then the lessons taken will be charged at our normal rate and the refund for cancelation of lessons will also apply.

Driving test 
All Mitchells School of Motoring Instructors must be satisfied that the student is at driving test standard or the Instructor has the right to withhold the car and the lesson fee still payable. 
When you attend your theory or practical test you MUST take the required documents with you, failure to do so will mean the examiner may have to cancel your test and you will forfeit your test fee and have to apply for a new test date. Instructors are not liable for you taking the correct paperwork.
Hire of the car is extra and charged at our lesson rate. There is normally also a 1 hour lesson before the test. 
Mitchells School of Motoring Instructors cannot be held responsible for driving test cancelations and as such the full fee is payable and the Student is responsible for claiming the money back from the DSA. 
All Lights are to be checked by both pupil and instructor before the driving test and the Instructor cannot be held responsible for bulb failure after this time. 
Any Damage to the car on test is the pupil’s responsibility and for any excess on the insurance also for any fines or charges levied as a result of any motoring offence committed during the test. 
The Instructors cannot be held responsible for any damage to Students clothes during the show me tell me part of the driving test. 
Driving tests take priority over lessons, therefore, pre-booked lessons may have to be cancelled or postponed if the instructor receives short notice of a driving test appointment. 
All Accounts must be settled prior to taking the driving test.

Distance Selling Regulations 
Under the Distance Selling Regulations, you have a right to cancel your order for any services purchased from Mitchell's driving school or any Driving Instructor trading under the school name for a full refund, within 7 working days of the date of confirmation, unless the services begin sooner.
If you wish to cancel an intensive courses or bulk driving lessons, such requests must be made in writing or email to receive a full refund.
You must write or email to us at the address below quoting your name, address & course start date.
Cancellations by phone will not be acceptable under (DSR office of fair trading guidelines).
You must obtain a proof of posting from the post office as you may be asked for this later.
The contract becomes binding when we confirm that we have accepted your order. 
Conformation may be by phone when we arrange the first lesson date and start time or when we send out a gift voucher.
